By providing your phone number and opting in, you agree to these Text Messaging & Call Terms of Service (“Terms”) and our Privacy Notice for Messaging (together, the “Messaging Terms”). If you do not agree, please do not opt in.

These Messaging Terms cover how we obtain, use, and safeguard your information when you:

  • submit a form on our website, avetransactions.com (the “Site”);

  • opt in to receive SMS or voice calls;

  • otherwise communicate with us regarding Avenue Transactions’ services.

Consent is not required to purchase our services. Message & data rates may apply. Carriers are not liable for delayed or undelivered messages.

1) Program Description & Scope

When you opt in, you may receive:

  • Transactional messages: file/transaction updates, compliance notices, appointment reminders, document status, and service alerts.

  • Service communications: onboarding steps, checklists, educational tips, and account/support notices.

  • Promotional messages (optional): offers, announcements, and event invitations.

You may receive communications via SMS/MMS and phone calls (manual or automated).

2) Consent to Receive SMS/Calls

By submitting your phone number and affirmatively opting in (e.g., checking a box, entering a code, or replying with a keyword), you authorize Avenue Transactions to send you recurring SMS messages and to call the number provided.

  • Consent is optional and not a condition of purchase.

  • You confirm you are the current subscriber or customary user of the number provided.

  • If your number changes, you agree to tell us so we can update or remove it.

3) Message Frequency

Message frequency varies by activity (e.g., number of files in progress). Typical ranges:

  • Transactional/Service: 0–10 messages per file/week (varies during milestones).

  • Promotional: up to 4 messages/month (only if you separately opt in).

4) Opt-Out & Help

  • Stop SMS: Reply STOP to any message to unsubscribe from that messaging program.

  • Resume: Reply START, UNSTOP, or opt in again through our forms.

  • Help: Reply HELP for assistance or contact support@avetransactions.com.
    After opting out, you may still receive non-marketing communications by email/phone if reasonably necessary to complete an active transaction or meet legal obligations.

5) Cost & Availability

Message and data rates may apply. Availability may vary by carrier and device. Delivery is not guaranteed. Wireless carriers are not liable for delayed or undelivered messages.

6) Eligibility & Responsibility

You must be 18+ and provide a valid U.S. mobile number. You are responsible for:

  • keeping your contact info current;

  • securing your device;

  • charges assessed by your carrier.

7) Privacy Notice for Messaging

A. Information We Collect

You provide: name, email, phone number, brokerage/role, and any details you share in forms or messages (e.g., file IDs, dates, scheduling preferences).
Automatically: device and network metadata (e.g., timestamp, delivery status), limited analytics about message performance (open/click/deliver where supported).
Transactional data: message content we send/receive to support your transaction coordination and compliance services.

B. How We Use Your Information

We use your data to:

  • provide, manage, and improve our TC services;

  • send transaction updates, reminders, and required notices;

  • communicate scheduling, onboarding, and support;

  • (if opted in) send promotions and announcements;

  • comply with law, enforce our terms, and maintain records.

C. How We Share Information

We do not sell your phone number to third parties for their marketing. We may share with:

  • Service providers (e.g., messaging platforms, CRM, payment processors) under contract;

  • Legal/Compliance recipients if required by law, subpoena, or to protect rights.

D. Your Choices & Controls

  • SMS Opt-Out: reply STOP.

  • Email Opt-Out: use the unsubscribe link in emails.

  • Access/Deletion Requests: email support@avetransactions.com.

E. Data Security & Retention

We use reasonable administrative, technical, and physical safeguards. No method is 100% secure. We retain messaging records for business, audit, and legal purposes consistent with our retention schedule and applicable broker-compliance requirements.

F. Third-Party Links/Tools

Our Site and messages may link to third-party services (e.g., Calendly, payment portals). Their practices are governed by their own policies.

8) E-Sign Disclosure & Electronic Records

By opting in, you agree to receive messages electronically and that electronic records (including logs of your opt-in/opt-out) satisfy any legal requirements for written communications. You may withdraw consent by opting out (see Section 4).

9) Changes to These Messaging Terms

We may update these terms at any time. We will post the “Effective Date” above. Continued participation after changes means you accept the updated terms.

10) Disclaimers & Limits of Liability

Messaging services are provided “as is.” We are not responsible for delays, failures, or inaccuracies caused by carriers, networks, devices, or third-party platforms. To the maximum extent permitted by law, Avenue Transactions disclaims indirect, incidental, special, or consequential damages arising from or related to the messaging program.

11) Governing Law & Dispute Resolution

These Messaging Terms are governed by the laws of the State of Colorado, without regard to conflict-of-law rules. Disputes will be resolved in the state or federal courts located in El Paso County, Colorado, unless applicable law requires otherwise.
